Powerful women in Kenya are subject to a certain kind of curiosity, a low hum of public interest that is more concerned with what they do or don’t do in private than with their professional accomplishments. For more than ten years, Justice Njoki Susanna Ndungu has endured that hum. When you ask most Kenyans about her, they will tell you about the Sexual Offenses Act, the presidential petitions she oversaw, or the astute legal mind that never seems to overlook anything. However, when you ask them a personal question, such as whether Njoki Ndungu has a husband or not, their responses become far less definitive.
One of East Africa’s most distinguished legal scholars, Justice Ndungu, is single. She is a single mother who gave birth to a child in 2013, which coincidentally happened to be one of the busiest years of her career due to the presidential election petitions that dominated Kenya’s legal system. The symbolism there is difficult to ignore. She was discreetly navigating the most intimate kind of milestone on her own terms while the nation anxiously awaited constitutional rulings.

Ndungu, who was born on September 20, 1965, was raised in a Kenya that had limited expectations for women. In retrospect, the fact that she briefly attended Valley Secretarial College in Nairobi after graduating from Kenya High School seems almost startling given where she ultimately ended up. She continued her legal studies at the University of Nairobi before graduating from the University of Leicester in England with a Master of Laws in Human Rights and Civil Liberties. She also graduated from World University Services in Austria with a diploma in women’s human rights. For someone who was always going to dedicate her life to fighting for something greater than herself, this type of academic record reads like a blueprint.
She passed through a number of important institutions in her early career. She worked as a State Counsel in the Office of the Attorney General from 1989 to 1993, which was a formative and grounding period that gave her an inside look at how the law actually operates in practice rather than just on paper. After that, she worked at the Institute for Education in Democracy, then as a National Protection Officer at the UNHCR Kenya Branch Office, and finally as a Political Analyst at the African Union. These movements weren’t lateral. Her understanding of justice, displacement, and power was sharpened in different ways by each position.
Parliament is the aspect of her career that most people are most familiar with. Between 2003 and 2007, NARC nominated her to the 9th Parliament, but she came with a legislative agenda rather than as a passive seat-filler. She was the main architect of the Sexual Offences Act of 2006, which is still referred to as the “Njoki law.” She also pushed for important changes to the Employment Act that guaranteed Kenyan workers paid maternity and paternity leave. These were not minor triumphs. They were the kind of structural shifts that subtly alter people’s everyday lives long after the headlines have faded.
Based on her record, it appears that Ndungu has always been more interested in creating systems than in holding positions. On June 11, 2011, when she was appointed to Kenya’s first Supreme Court, detractors who had observed her in Parliament publicly expressed concern that she was too much of an activist and too devoted to a specific vision of equality to act as an impartial arbiter. Criticism might have completely missed the point. The legal system has never been completely impartial, particularly when it comes to constitutional law. People wrote it, people interpreted it, and people used it. Ndungu brought a unique fluency in the human cost of legal decisions to that bench.
There have been times when her publicly known personal life has uncomfortably collided with the news cycle. Periodically, questions concerning Njoki Ndungu’s husband appeared in tabloid-adjacent Kenyan media outlets; these questions were frequently phrased in a way that revealed more about the questioner than the subject.
The fact that she is raising a child by herself is known, and she hasn’t made an effort to conceal it. In addition to having one of the most significant legal careers in Kenya’s post-independence history, she became a mother in 2013. That story doesn’t have a clear lesson. After Judge Mohammed Kadhar Ibrahim passed away in January 2026, Justice Ndungu was elected to the Judicial Service Commission without opposition. Having practiced law for more than 35 years, she currently serves as the chair of the Board of Trustees of the Gender Violence Recovery Center at Nairobi Women’s Hospital and mentors adolescent girls via the Big Sister Program.
